Many are mistaken with the services provided by the Commissioner for Oaths or also known as Pesuruhanjaya Sumpah in Malaysia. Although some Commissioners are advocates and solicitors, there are some who maintain the tasks of Pesuruhanjaya Sumpah only. So, what is a Commissioner for Oaths?

People are often confused with this matter. The Pesuruhanjaya sumpah is a witness who verifies that you have signed the papers in his presence. Don’t be confused with people or organizations which verify documents. They will make sure you sign the documents in front of them and later sign there as witnesses to your signature.

People or organizations tend to feel more secured if there is a stamp or signature of the Commissioner for Oaths as they do not only become the witness of your signature but also read the documents to see if it is worth signing it or not. They will notify you of any questionable or dubious clauses and prevent you from signing the papers. At the same time, the Oaths officer will ask whether you had fulfill all terms with the conditions and fully understand what you are signing. How much do I have to pay?

Well, the fee of signing documents is the same for every state in Malaysia, including Sabah & Sarawak. The price is RM 4 per signature for original copy and RM 2 per signature for duplicate copy. The price should not exceed these two amounts.

Every Pesuruhanjaya Sumpah has a record book where the people who require their services to become the witness of signing any documents have to write down their information such as who are you, your identity card number and the type of documents that you have signed. They have to keep record of every signature they give away.

The Commissioner for Oaths can only sign any papers at his office in front of him. This is one of their job scopes. They have to ensure that you sign in front of them and you are present when the signature is taking place. If they are more than one party involved, everyone should be present there for the signing. All of the parties have to sign the papers at once in front of the officer himself.

Commissioner for Oaths is NOT QUALIIFIED to verify documents. They are forbidden to do that. They can lose their license if they do. They can only become a witness of the signing. But at the same time, they are allowed to verify Statutory Declaration of any sort. The price might be different for this, it is around RM 10 or more.
